Terms of Service
Welcome to transformcxo.com (the "Site"), operated by Kristina Worldwide LLC, a Colorado limited liability company doing business as TransformCXO ("TransformCXO," "we," "us," or "our"). These Terms of Service govern your use of the Site. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who may use the Site
The Site is intended for business owners, leaders, and professionals who are at least 18 years old. By using the Site, you confirm that you meet this requirement.
2. Information, not professional advice
The articles, podcast episodes, assessments, tools, and other content on the Site are provided for general informational and educational purposes. They are not legal, tax, accounting, financial, investment, or valuation advice, and they are not a substitute for advice tailored to your specific situation. Before making significant business, financial, or transition decisions, please consult qualified professionals.
3. No client relationship
Using the Site, completing an assessment, contacting us, or scheduling a Discovery Call does not create a client, advisory, or fiduciary relationship with TransformCXO. That relationship begins only when you and TransformCXO sign a written agreement, and the terms of that agreement govern our work together.
4. Assessments and tools
The Founder Freedom Score and any other assessments or tools on the Site are self-reported diagnostic tools. Your results depend entirely on the answers you provide and are meant to prompt reflection and conversation. They are not a formal business valuation, an operational audit, or a prediction of future performance. Please review the Founder Freedom Score Disclaimer before relying on your results.
5. Our intellectual property
The Site and its content, including text, graphics, logos, videos, podcast episodes, assessments, scoring methods, and frameworks such as the Founder Freedom Score and the Value Growth Process, are owned by TransformCXO or our licensors and are protected by intellectual property laws.
You may view, download, and print content from the Site for your own personal or internal business use. You may share links to the Site and short excerpts with clear attribution to TransformCXO. You may not copy, reproduce, modify, distribute, sell, or create derivative works from our content, assessments, or frameworks without our written permission.
Other names, logos, and trademarks referenced on the Site belong to their respective owners and are used for identification only. Their appearance does not imply endorsement.
6. Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false information or impersonate another person or company
- Attempt to gain unauthorized access to the Site or its systems
- Interfere with the Site's operation, including by introducing malicious code
- Use automated tools to scrape, copy, or collect content or data from the Site
- Copy or reverse engineer our assessments or scoring methods
7. Information you submit
You are responsible for the accuracy of the information you submit through the Site. Our Privacy Policy explains how we collect, use, and protect it. Please do not send confidential or sensitive information through the Site's general forms. If a conversation calls for it, we will arrange an appropriate way to share it.
8. Links and third-party services
The Site may link to websites, platforms, scheduling tools, and podcast services operated by others. We do not control them and are not responsible for their content, policies, or practices. Your use of them is governed by their terms.
9. Disclaimer of warranties
We work hard to keep the Site accurate and useful, but it is provided "as is" and "as available." To the fullest extent permitted by law, TransformCXO makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components, or that any particular result will follow from using it.
10. Limitation of liability
To the fullest extent permitted by law, TransformCXO and its owners, team members, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the Site or its content. Our total liability for any claim arising from the Site will not exceed one hundred U.S. dollars ($100).
This section does not limit liability that cannot be limited under applicable law, and it does not apply to services provided under a separate written agreement, which that agreement governs.
11. Indemnification
You agree to indemnify and hold harmless TransformCXO and its owners, team members, and contractors from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. If a concern arises, please contact us first. Most issues can be resolved through a direct conversation. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Weld County, Colorado, and you consent to the jurisdiction of those courts.
13. Changes to the Site and these Terms
We may update the Site or these Terms at any time. When we update these Terms, we will revise the effective date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
We may suspend or discontinue access to the Site, in whole or in part, at any time.
14. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and TransformCXO about your use of the Site.
